(AllHipHop News) Hip-Hop mogul Bryan “Birdman” Williams has lost his bid to have a lawsuit regarding unpaid wages thrown out of court.
The rapper’s attorney Alan Soven challenged the lawsuit, insisting Nuno was never on Williams’ payroll and claiming his client wasn’t properly served with legal papers.
“You can’t serve a security guard,” Alan Soven, Birdman’s attorney told The Miami Herald. “You can’t serve the maid or the gardener. You have to serve someone who lives at the house, and I can promise you the security guard doesn’t live in Bryan’s mansion.”
In paperwork filed with the court, Soven has argued Nuno was never an employee of Williams’ and was merely a hanger-on who lived on the property for years and wouldn’t leave when Williams bought the place in 2012.
He moved to have the Florida case dismissed, but Miami-Dade County Circuit Court Judge Rodney Smith has denied Williams’ motion, allowing Nuno to proceed with his efforts to fight for the money he alleges he is owed, reports The Miami Herald.
He is also seeking payment for overtime and damages.
It’s the second suit Nuno has filed against Williams.
He initially launched legal action in 2015, but voluntarily withdrew the papers in February, 2016, before lodging new documents in court last summer, in August of 2016.
