(AllHipHop News) Multi-platinum New Orleans rapper C-Murder was on the losing side of a Supreme Court verdict yesterday (February 19), that will uphold his life long sentence for allegedly murdering a 16-year-old fan in 2002. While the Supreme Court ruling keeps the former No Limit rapper and TRU Records label head behind bars, organizations like the NAACP have suggested that there be an investigation into the jury’s deliberations that ruled 10-2 to convict C-Murder. In Louisiana, a vote of 9-3 wouldn’t have been enough to convict C-Murder and jurors have come out after the trial admitting that “abusive” persuasion and threats existed throughout the juror’s deliberations. The case also brings up the heavily contested legal debate at the federal and state levels about whether or not a unanimous vote should be required to convict potential criminals. The latest appeal reached Louisiana’s Supreme Court. “No DNA,” Miller’s legal team wrote in one of two briefs filed at the 5th Circuit Court of Appeal. “No fingerprints. No gun. No ballistics. No testing for gunshot residue. No incriminating statements. Not one piece of physical evidence directly linking Corey Miller to the shooting. The irreconcilable tales of two flip-flopping, deal-driven and reluctant (to testify) witnesses is the only evidence propping up the state’s case.” Despite this, C Murder’s appeal was rejected, and now the rapper must serve life in prison for the murder of a 16-year-old named Steve Thomas, in a now defunct nightclub in Jefferson Parish, Louisiana.
(AllHipHop News) Incarcerated rapper C-Murder will have to wait to see if he will be able to appeal a 2009 murder conviction. The rapper’s appeal was one of several major cases for the U.S. Supreme Court to review this week, but it was not on the docket for unknown reasons. According to the Times-Picayune, no explanation was given for the delay, but it could be for several reasons, as Justices of the Supreme Court could have had asked for more time to consider the appeal. C-Murder, born Corey Miller, was given a mandatory life sentence in Angola prison, after he was convicted of the 2002 death of 16-year-old Steven Thomas. Thomas was shot to death inside of a now defunct, Harvey nightclub during a dispute. Although witnesses placed C-Murder inside of the club, none were actually able to identify him as the person actually firing a weapon. Defense witnesses have long claimed that another man, who is now deceased, was the person inside of the club that was responsible for shooting Thomas. C-Murder has been convicted of the crime twice already. In the first trial in 2003, the rapper was convicted, but that was overturned on appeal, when it was learned prosecutors expunged the criminal records of their witnesses. During the 2009 trial, 10 of the 12 jurors found C-Murder guilty of Thomas’ death. But as jurors were deliberating, one woman claimed that he was placed under undue stress to reach a verdict. Other jurors accused another member of the jury of sleeping and reading the Bible during the deliberations. Shortly after the case, the woman spoke to the media about the pressure she was under to make her decision. The juror, Mary Jacob, told reporters shortly after the guilty verdict that she voted, because a Nother, younger insurer had become ill during the deliberations, since she believed see murder was innocent. “They literally made this 20-year-old girl so violently ill,” Mary Jacob said. “She was shaking so bad. She ran into the bathroom. She was throwing her guts up. She couldn’t function anymore. That’s when I decided, the judge don’t want to listen to me, doesn’t want to listen to us? I told them, ‘You want him to be guilty? He’s guilty, now let’s get the hell out of here.”’ According to the Times-Picayune, the high Supreme Court approves less than 2% of the appeals that are filed annually.

C-Murder, 41, was convicted in 2003, for the 2002 shooting of a 16-year-old named Steven Thomas, inside a now-defunct, Harvey nightclub. In 2006, the verdict was overturned on appeal, when it was learned that prosecutors expunged the criminal backgrounds of various witnesses, in order to bolster their credibility on the stand. C-Murder’s second trial in 2009 also ended in controversy. During the deliberations, a juror who voted to convict C-Murder claimed that she was brutally pressured to reach her decision. Despite her belief that C-Murder was innocent, she claimed she voted guilty, due to pressure from the jury and the judge, to reach a verdict. C-Murder was eventually convicted 10-2, which was all that was needed for a conviction in the state of Louisiana.

The rapper, whose real name is Corey Miller, is the brother of Percy Miller, also known as No Limit Forever founder Master P. The three judge panel from the 5th Circuit Court of Appeals denied Miller’s defense that he didn’t get a fair trial in the shooting of a teenager in 2002. Seven years later, the jury convicted Miller of second degree murder in 2009 for killing the 16-year-old boy in a nightclub. Miller claims the judge who carried out the trial allowed jurors to hear prejudicial and unsubstantiated testimony, and that witnesses were threatened. In addition to the aforementioned claims, Miller says the prosecution intentionally eliminated Black people from the jury. All claims were denied. According to ABC News, one of Miller’s attorneys didn’t immediately return phone calls.
